Constitutional Storm

ED NOTE; ‘people & person’ inserted here, although the grammar doesn’t seem correct.  This is the description in 2nd. Amendment and Article 2a.  I tried to word my request to the County Attorney Saffo and Sheriff Dutile similar, if it would be written before the Civil War, except the UCC feature.  The intent was no reference to the 14th. Amendment.  Whether this was accomplished????   I was up until 2:00 A.M. Friday morning putting an informational piece together, I deleted by mistake.  I was bit angry with myself, plus being sick all week didn’t help.

I will insert quotes and parts of court decisions.  The quotes and decision are all pertaining to ‘the outreach’ and consequences at Plymouth State University and Justice Vaughn’s most abominable, dastardly court order imaginable.

Most of what is posted here can be found at   The liberty activist live by the motto of ‘Peaceful Revolution. They do practice civil disobedience.  Anybody that advocates violence are not allowed to participate.  Remember government is the only one that has a monopoly on violence.  You don’t believe it, don’t pay the rent on your land, see what happens.

A question of major proportions.  Should the chief of police at PSU and Justice Vaughn be impeached,  separated from their pensions?

The Northern Pass is of  concern with most people in the North Country.  When the legal wrangling starts, people/person will be seeking protection from Article 12a, Eminent Domain.  Justice Vaughn just displayed the State Constitution has no meaning.   On this issue he kick the full milk bucket over.  Depending on the outcome of the hearing, Tuesday December 13, 2011 at 2:30 P.M..  If  Justice Vaughn apologizes for His error, I will do the same, put it all behind us.  Providing person/people may enter public property without being molested by government.  I also expect a public apology from the police chief of PSU after my letter to the editor.

"Laws that forbid the carrying of arms ... disarm only those who are neither inclined nor determined to commit crimes ... Such laws make things worse for the assaulted and better for the assailants; they serve rather to encourage than to prevent homicides, for an unarmed man may be attacked with greater confidence than an armed man." -- Thomas Jefferson (1764) -- Quoting 18th Century criminologist Cesare Beccaria in On Crimes and Punishment

“You can only protect liberties in this world by protecting the other man’s freedom.”
Clarence Darrow

"The people are the masters of both Congress and the courts, not to overthrow the Constitution, but to overthrow the men who would pervert it!"

"Occupants of public offices love power and are prone to abuse it."
George Washington , Farewell Address

"Each of us has a natural right to defend his person, his liberty, and his property."
Frederic Bastiat

“Poor people have access to the courts in the same sense that the Christians had access to the lions.”
Judge Earl Johnson, Jr.

"An unconstitutional act is not a law; it confers no rights; it imposes no duties; it affords no protection; it creates no office; it is in legal contemplation, as inoperative as though it had never been passed." Norton v. Shelby County, 118 US 425 (1885)

"Where rights secured by the Federal Constitution are involved, there can be no rule-making or legislation which would abrogate them." Miranda v. Arizona, 384 US 436 (1966)

"Justice will not be served until those who are unaffected are as outraged as those who are."
Benjamin Franklin

“Remember that a government big enough to give you everything you want is also big enough to take away everything you have.” ~Barry Goldwater

An unconstitutional legislative enactment, through law in form, is in fact not law at all. It confers no rights; it imposes no duties; it affords no protection; it is in legal contemplation as inoperative as though it had never been passed. Bonnett v. Vallier, 116 N.W. 885, 136 Wis. 193 (1908); Norton v. Shelby County, 118 U.S. 425, 442.

The usual road to slavery is that first they take away your guns, then they take away your property, then last of all they tell you to shut up and say you are enjoying it. – James A. Donald

Arms are the only true badge of liberty. The possession of arms is the distinction of a free man from a slave. – Andrew Fletcher

Remember Barry Goldwater’s Quote.  Extremism in the defense of Liberty is no vice.
And let me remind you also that moderation in the pursuit of justice is no virtue.”

Open Response to the Robed Man Who Believes He Controls This Blog

If you’ve been reading this blog in the last week, you are aware of the controversy brewing around FK blogger and former cop Brad Jardis’ plan, along with former military member Tommy Mozingo, to walk onto the campus of Plymouth State University with guns, openly carried. Their purpose was to educate the students about their supposed right to carry weapons for self-defense. He announced it in advance here three days ago and since the government university system has been freaking out.
Now they have gone to the courts to save them from the peaceful gun rights demonstration and outreach event. A man who wears a robe has decreed some pretty outrageous stuff in a “TEMPORARY RESTRAINING ORDER”, issued today to Brad and Tommy.
First, Brad and Tommy are “enjoined” from carrying any weapons on any state university campus, including Keene State and UNH. But not just Brad and Tommy, also “their officers, agents, servants, employees, and attorneys; and any person acting in active concert and participation with Bradley Jardis and Tommy Mozingo”.
Second, Brad and Tommy (who does not have a blog account here) are both ordered to post the order to this website! The relevant paragraph:
Bradley Jardis and Tommy Mozingo are ordered to post a copy of the Temporary Restraining Order on the blog/website in order to provide notice of the enjoined activities to any individuals who plan to bring firearms or other prohibited weapons to the Plymouth State University campus, or any other campus administered by the USNH Board of
Trustees, in response to the “press release.”
The “ORDER” goes on to threaten anyone who brings a weapon on a state campus with “contempt of court” and arrest, “after receiving notice of the Temporary Restraining Order”.
So in America, people are supposed to have the freedom of speech. Doesn’t that also mean one should have the freedom NOT to speak? What obligation (besides the threat of a cage) does Brad have to do as he was told by this robed man? Can the robed man also order Brad, or you dear reader, to do anything he wants them to? Can he order Brad to do fifty pushups?
This particular man in the robe, Timothy J. Vaughan, appears to believe that he can just wave his little pen and have us obediently post his ramblings.
To Timothy J. Vaughan and other robed men: This blog is not your property. You do not get to tell us what to post here. Sure, you have men with guns and cages and you are very scary to a lot of people. Usually you can get your way through intimidation. You’re used to everyone telling you “yes, your honor”. Well, those of us here at Free Keene are telling you, “NO.” What you do is not honorable. You are just a human, like all the rest of us. You may be able to get away with threatening and harming peaceful people, but that doesn’t make you better – it just makes you a tyrant.
The only reason this article linked to your outrageous “ORDER”, was to prove to people that it was real. One attorney, when interviewed about this, commented that he has never heard of an order compelling action like this. Please note for the record, your paperwork has not been posted in full anywhere on this blog.
Free Keene is a news and opinion outlet that supports free speech and its converse, the right to remain silent. The people who blog here don’t appreciate you telling us what to do.
If you don’t like it, you could always try writing an “ORDER” telling us to bow before you, kiss your ring, and lick your boots. I bet that would really turn you on.

My request to the County Attorney Saffo and the Sheriff Dutile.   I was planning attending the challenge and out reach as a person, not a participant at PSU. I did have some fear, from the people with badges.  This whole nightmare started due to the chief of PSU police violating his oath of office.  So if he’s derelict in his oath, how do I know his officers are using steroids.  Steroids is a major cause of violence in law enforcement.  Have doubt, Google it or   Over 513 persons have die since 2001 from tazers.  Many deaths are result of potassium imbalance in the blood, I have a potassium imbalance.  If I get tazered, death would be certain.  While I don’t know how the Sheriff thinks or his stance Constitutionally  I do know He is a nut and bolts person, put my faith in Sheriff Dutile to protect me and everyone else in attendance.  Hopefully He would protect every one’s rights.  The court order removed the opportunity of the county attorney and sheriff to prove what they stand for.

My Request, neither has responded.

Ms. Lara Saffo
County Attorney of Grafton County

Mr. Douglas Dutile
Sheriff of Grafton County

Dear Officers

Re: Challenging of Directive by UNH officials forbidden firearms (arms) at Plymouth State College

The issue is of utmost concern as a law abiding Patriotic American.   A directive that denies an armed citizen the right to enter public property is illegal.  Any restrictions of pedestrian movement or travel on public property, that infringes association, legal right to be or citizen(s) privacy is also illegal.

The two men’s rights planning on challenging the directive must be protected .  You two are the highest law enforcement officers of Grafton County.   I will remind you, you took an Oath to uphold the State   Constitution for New Hampshire  and the Constitution for united States of America .  As a sovereign of the united States of America, Residing in New Hampshire, I expect everyone’s Rights be protected, myself included, at Plymouth State University, Friday morning, tomorrow.

There is an appearance an agreement has been agreed upon, all parties involved.

Any  response will be greatly appreciated.

To the tragedy that just unfolded near the Virginia Tech campus.
Here is my reply:
When I was a police officer in Epping I once arrested a man who was in possession of a stolen .22 caliber Röhm handgun. He was on his way to kill a witness in a grand jury proceeding in Kingston at the behest of his criminal organization.
This man had five violent felony convictions on his criminal history. Having more than three violent felony convictions on his record and being in possession of a firearm subjected him to a potential fifteen year federal prison term and a ten year state prison term. He was charged by the Rockingham County Attorney and sentenced to ten years in state prison.
Criminals, like the one who just shot the police officer near the Virginia Tech Campus, and the one I arrested in Epping, simply are not dissuaded by even the severest penalties imposed by law to curb their predatory behavior.
Gun control laws only make it easier for violent predators to choose a location that they know will offer them almost no resistance to their evil acts… and that is because law-abiding people typically adhere to ridiculous firearm restrictions.
This leaves everyone vulnerable and gives criminals the upper hand. Now more than ever responsible and law-abiding people in vulnerable settings like public universities need to think seriously about being proactive about their safety.
PSU students: please, don’t advocate for taking away your own self-defense rights. Criminals don’t care about the law.
The law only hurts good people, like you
