NH GOP - Shea-Porter Changing Her Tune on FISA

CONCORD – New Hampshire Republican Party Chairman Fergus Cullen releases the following statement regarding Representative Carol Shea-Porter’s public statements on the Foreign Intelligence Surveillance Act:

“Carol Shea-Porter’s misleading and naïve remarks on FISA today demonstrate that she is living in a pre-9/11 world. The threat of terrorism we face is real. As much as she would like to pretend otherwise, Shea-Porter and House Democrats have left the US intelligence community without all the necessary tools to protect the nation.”

Carol Shea-Porter Claims That Supporters Of FISA Are Trying To “Terrify Americans,” While She “Knows What’s At Stake”

“I Think This Is A Cynical Attempt To Terrify Americans Into Giving Up Their Freedoms Guaranteed By The Constitution And Also To Get Us To Agree To Give The Phone Companies Retroactive Immunity When They Clearly Broke The Law[.]” (Lauren R. Dorgan, “Shea-Porter Decries Ads,” Concord Monitor , February 26, 2008)

Shea-Porter Says She “Knows What’s At Stake.” “Shea-Porter shot back, saying she knows what’s at stake. ‘They don’t need to teach me risk and fear,’ she said, recalling where she and her family were on 9/11. ‘I get it.’” (AdamD. Krauss, “Shea-Porter Calls Attack Add ‘Cynical,’ ‘Ugly,’” Foster’s , February 26,2008)

Yet Members Of The Intelligence Community And Other Democrats Have Agreed That The Quality Of Intelligence Gathered Has Been Degraded

Attorney General Mukasey And Director Of National Intelligence Mike McConnell: “We have lost intelligence information this past week as a direct result of the uncertainty created by Congress’ failure to act.” (Attorney General Michael Mukasey and Director Of National Intelligence Mike McConnell, Letter To Chairman Of The House Permanent Select Committee On Intelligence, 2/22/08)

Chairman Of The Senate Intelligence Committee Senator Jay Rockefeller (D-WV): “What people have to understand around here is that the quality of the intelligence we are going to be receiving is going to be degraded. It is going to be degraded. It is already going to be degraded as telecommunications companies lose interest.” (Sen. Jay Rockefeller, Floor Remarks, 02/14/08)

Shea-Porter Claims That Warrants Can Be Obtained In “Minutes” Or Even “After The Fact”

“Shea-Porter called the ads a ‘plain lie,’ saying that agencies still can obtain the right to intercept communications under a secret intelligence court and can, in case of emergency, apply for a warrant after the fact.” (Lauren R. Dorgan, “Shea-Porter Decries Ads,” Concord Monitor , February 26, 2008)

“‘What people need to know is they can still get a warrant — just go to the FISA court. It takes minutes,’ she said.” (AdamD. Krauss, “Shea-Porter Calls Attack Add ‘Cynical,’ ‘Ugly,’” Foster’s , February 26,2008)

But In Reality This Process “Takes Time And Results In Delays,” Leading To A Loss Of Some Intelligence

Attorney General Michael Mukasey and Director of National Intelligence (DNI) Mike McConnell:

Ø “FISA was designed to govern foreign intelligence surveillance of persons in the United States and therefore requires a showing of  ‘probable cause’ before such surveillance can begin. … The process of compiling the facts necessary for such a determination and preparing applications for emergency authorizations [approved by the Attorney General] takes time and results in delays.”  (Attorney General Michael Mukasey and Director Of National Intelligence Mike McConnell, Letter To Chairman Of The House Permanent Select Committee On Intelligence, 2/22/08)

Ø “Imposing this requirement in the context of surveillance of foreign targets located overseas results in the loss of potentially vital intelligence by, for example, delaying intelligence collection and thereby losing some intelligence forever.” (Attorney General Michael Mukaseyand Director Of National Intelligence Mike McConnell, Letter To Chairman Of The House Permanent Select Committee On Intelligence, 2/22/08)
