This morning liberal Supreme Court Justice John Paul Stevens announced he will retire this summer, giving President Obama his second chance in just one year to fill another of the nine seats on our nation's highest court.
Do you remember last summer's controversy over Obama's first Supreme Court pick, Sonia Sotomayor? Judge Sotomayor made it clear in her past statements and rulings that she would not hesitate to use the court to implement her own liberal political policies, instead of respecting the role of the judiciary as an impartial and limited body. That's why I came out strongly at the time, declaring that I would have voted against Sotomayor's confirmation.
But my opponent, Kelly Ayotte, said publicly that she would have voted yes on Sotomayor, and supported her nomination to the Supreme Court! In less than a year on the bench, Sotomayor has proven that she is indeed a liberal judicial activist who does not respect her role as an impartial judge but instead would use her perch on the Court to advance the Obama agenda and view of the Constitution. Naturally, Paul Hodes shares Kelly Ayotte's position and also supported the extremely liberal Judge Sotomayor. New Hampshire and this nation cannot afford to elect a Senator who will allow the President to trample on the Constitution to further his liberal agenda, and that's why I'm reaching out to you.
Will you stand with me today in opposition of liberal judicial activism by making a contribution of $25, $50, $100, $250 or more to my campaign? As an American and a candidate for U.S. Senate, I believe that providing "advice and consent" on federal judicial appointments is one of the most important responsibilities a Senator has, and must be handled with great care. I could not vote in favor of a nominee who does not have a record of faithfulness to the Constitution and respect for the limited role of the court in our representative democracy. Judges are not accountable to the people, and that is why they cannot dictate policy to us, as Barack Obama, Sonia Sotomayor, and Kelly Ayotte would allow them to do.
Supreme Court Chief Justice Roberts has said that the proper role of a judge is simply to apply the law impartially to everyone who comes before the Court - to act as a neutral umpire. I could not agree more. That's why I'm dedicated to making the case to the President - whether Barack Obama right now or someone else years from now - to nominate judges who will not make policy from the bench, but impartially interpret our laws, and uphold the Constitution without bias.
