NH DHHS - State Investigates Manchester Orthodontic Practice for Improper Infection Control

Doctor’s License Suspended

Concord, NH – Attorney General Joseph A. Foster and the New Hampshire Board

of Dental Examiners announce that the Board has suspended the license of

Nicholas Marshall, Jr., D.D.S., of Manchester, New Hampshire, effective

April 28, 2014.

The Board’s action is in response to findings made by investigators for the

Board during an unannounced inspection of Dr. Marshall’s practice at 835

Hanover Street, #202 in Manchester, New Hampshire on April 24, 2014. As a

result of the inspection, the Board found that Dr. Marshall’s practice, as

currently operated, poses an imminent threat to the life, safety and/or

health of his patients.

On April 28, 2014, the Board issued an Order of Emergency Suspension and

Notice of Hearing. This order suspended Dr. Marshall’s license

immediately. A public hearing before the Board is currently scheduled for

4:00 p.m. on May 22, 2014, for the purpose of determining whether Dr.

Marshall’s license will remain suspended.

The Attorney General’s Office notified the Department of Health and Human

Services (DHHS) Division of Public Health Services about possible improper

infection control practices at the office. DHHS staff, in collaboration

with the Manchester Health Department and the New Hampshire Board of Dental

Examiners, are investigating to determine the potential scope of the

breaches and have determined that the risk of infection for patients is

very low. DHHS is recommending that patients who are concerned speak with

their healthcare provider about the possibility of being tested for HIV,

Hepatitis B, and Hepatitis C. Patients with questions or who do not have

from 8:00 am–4:00 pm. Only people who were patients of Dr. Nicholas

Marshall, Jr. are potentially at risk for possible exposure to blood borne
