Supreme Court to Rule on EPA’s Mercury Rule

Today, the Supreme Court is expected to rule on a challenge by more than 20 states and industry groups to EPA’s Clean Air Mercury Air Toxics Standards (MATS) Rule, also known as the Utility MACT (Maximum Achievable Control Technology) Rule.

Petitioners argue that the Clean Air Act (CAA) required EPA to take implementation costs into account when deciding whether MACT regulation of hazardous air pollutant (HAP) emissions from power plants is “appropriate and necessary.” EPA did not do so.

IN VICTORY FOR SMALL BUSINESSES, TEXAS RULING ELIMINATES ONEROUS OCCUPATIONAL LICENSING
 

On Friday, the Supreme Court of Texas ruled in favor of five eyebrow threaders and against a state agency that demanded 750 hours of conventional cosmetology training – most of it completely irrelevant and not involving eyebrow threading – and required them to pass two examinations, neither of which tested eyebrow threading. > Read more
