CHQ - Opposition Mounts to State Power Grab Over Private Charities

(Vienna, Virginia)  The Free Speech Coalition, a 501(c)(4) nonprofit organization based in Vienna, Virginia and dedicated to protecting the First Amendment rights of nonprofit organizations, issued the following statement about its opposition to misguided efforts by state charity regulators to implement a model state law now called the Protection of Charitable Assets Act:

"The Free Speech Coalition (FSC) has sent a letter of opposition, signed by 47 organizations, urging termination of the drafting process of this misguided, unconstitutional legislation currently called the Protection of Charitable Assets Act (the "Act").

"As word has leaked out about the proposed new, redundant regulation of nonprofit organizations with more than $5,000 per year income, they are becoming alarmed and are beginning to organize opposition to the new proposed model state law.

"Especially during this time of economic duress in the nonprofit world, new registration fees and additional reporting requirements, which the Act would implement, would further drain scarce nonprofit resources, depriving legitimate charitable programs of those funds.  The Act would also add more bureaucracy for states to finance despite their already severe financial circumstances.

"The drafting committee relied on anecdotal reports from regulators, not testimony of the general public or nonprofits themselves, as there has been no professional analysis of the issues state regulators claim this Act would address.  FSC asserts that existing laws are sufficient and already overly burdensome.

"The Act would harm many small and local charities.  The Act also contains serious constitutional violations under the 1st, 4th, and 5th Amendments, and violations of the doctrines of separation of powers and checks and balances, that would harm all nonprofits, and are intolerable under any circumstances.

"FSC's opposition is also based in its experience dealing with state charity regulators who would administer the Act and have already demonstrated a propensity to overreach and abuse law-abiding nonprofits."

The FSC letter in opposition to the Act is available at

The Uniform Law Conference Committee, whose members are appointed and are not elected officials, is responsible for drafting the Act (until recently called the Oversight of Charitable Assets Act).  They have held two meetings in Chicago, and a third meeting is this weekend.  A fourth, and presumably final, meeting is scheduled for July.

Shea-Porter Announces Congressional Asthma and Allergy Caucus

Urges Colleagues to Cosponsor  Asthma Management Plans in School Act

WASHINGTON, DC — Congresswoman Carol Shea-Porter has announced that she has created a new caucus, the Congressional Asthma and Allergy Caucus.  The Caucus, which was introduced yesterday as part of the Allergy and Asthma Network Mothers of Asthmatics’s (AANMA) Asthma Awareness Day, will work to educate Members of Congress about asthma and severe allergies, and to increase public awareness, and to advance research. Congresswoman Shea-Porter and Congressman Phil Gingrey (R-GA) will serve as Co-Chairs of the Caucus.

“Children and adult asthma sufferers in New Hampshire struggle with a dangerous and difficult disease,” said Congresswoman Shea-Porter. “The costs of asthma-related emergency room visits in New Hampshire total more than four million dollars each year.  This Caucus will allow Members of Congress on both sides of the aisle to work together to help find a cure for this disease.”

In her remarks at AANMA’s press conference, Congresswoman Shea-Porter also urged her colleagues to support her bill, the Asthma Management Plans in School Act (H.R. 4836).  This bill was introduced by Congresswoman Shea-Porter on March 12, 2010.  It would provide grants to schools to develop asthma management plans and to purchase asthma inhalers and spacers for emergency use.

“Asthma is one of the most common childhood diseases, and it is crucial that schools have the tools they need to help children who have an asthma attack in the classroom,” said Congresswoman Shea-Porter.  “My legislation would provide grants to schools to purchase devices for asthma sufferers, and help teach school administrators and teachers how to help a child suffering from an asthma attack.”

In New Hampshire, approximately 10.5% of adults (18 years and older) and 8.4% of children suffer from asthma.  Every year, nearly 4,000 adults and 3,000 children are newly diagnosed with asthma in the State.  Females in New Hampshire are more than twice as likely as males to have asthma, at 14.3% versus 6.4%.  Almost 70% of children with asthma in New Hampshire may not have their asthma under control and only 31.4% of children with asthma in New Hampshire receive what could be characterized as a minimum standard of asthma education.  Children with asthma are almost twice as likely to miss four or more days of school as those without asthma in the State.  In addition, New Hampshire emergency room costs total approximately $4.1 million per year for asthma-related issues.

Jeb Bradley - Merry Christmas and Heartfelt Thanks

Several weeks ago my E-newsletter outlined the situation of New Hampshire National Guard Soldiers training in Indiana for deployment to Afghanistan in January. The Milford based C Company 3/172nd Infantry were originally not going to be able to return home to family and loved ones for the Christmas Holidays. This is because the military cannot use funds to pay for the transportation of soldiers for this purpose, so soldiers must pay for their own transportation.
As I mentioned previously, the New Hampshire National Guard are unsung heroes among us; courageous and willing to serve our country. That service runs the gamut from rescuing people during floods to protecting our national security in faraway lands. For some this deployment represents their first tour of duty, while for others they have served our country several times.
Thankfully, the National Guard Association and Enlisted Association of New Hampshire (NGAEA of NH) do an incredible job assisting families while a husband or father, wife or mother is called to service. In this instance, NGAEA of NH was hoping to raise funds to charter busses to transport the troops home for several days around Christmas.
Due to the contributions of so many wonderful New Hampshire people, those funds have been raised and the troops will be returning home by bus on Wednesday December 23rd. The estimated arrival time is between 7 and 9 a.m. and the location is the Manchester Armory at 1059 Canal Street.  Directions and updated times can be found at: http://www.nganh.org/ . The soldiers will depart from the Armory on January 1, 2010 in the morning and updates on that departure can be obtained on the website.
So a huge heartfelt thank you is in order for everyone who contributed to this effort. I appreciate the assistance given to me by General Stephen Burritt and Lt. Col Michael Domingue. Also of particular note are significant contributions provided independently to this effort by fine New Hampshire companies, BAE Systems of Nashua and Dare Mighty Things of Portsmouth.
If you have a chance to stop by the Manchester Armory for the return or departure please consider doing so. Along with contributions that enabled them to return to New Hampshire and share Christmas with family, a visible show of support will buoy the spirits of these courageous citizen soldiers for the arduous and dangerous task ahead of them in Afghanistan.
Thank you again and my best wishes for a Merry Christmas!

Jeb Bradley
