Watchdog sued in libel claim 

Dear Supporter,

When the Franklin Center for Government and Public Integrity was established in 2009, we were told that if we wanted to do cutting-edge investigative journalism we needed to be prepared to be sued as we exposed the dark corners of government. 

I was told that when that occurred we would have arrived as a news organization.

Well I am happy to report that the Franklin Center has arrived.

This week a lawsuit was filed against us for stories my investigative team in Virginia did in exposing potential problems and questionable business dealings with a green energy company called GreenTech. 

What makes this story important is the close ties this company has with “former” chairman and Democratic Gubernatorial Nominee Terry McAuliffe and the fact that Hillary Clinton’s brother is also involved with this company. 

Our investigation obviously struck a nerve.  So much so, that attorneys for the Clinton/McAuliffe tied company are suing us for $85 Million.

Yes you are reading that correctly …. $85 million.  This appears to me to be a case of intimidation.

They grossly miscalculated because we will not be silent and we will continue to report on this and any story that is important to the public.

Are we scared? No, we have truth on our side and facts to back up our story. 

But we are taking this very seriously because if they can silence us they can silence anyone who dares to oppose bigger government and crony capitalism and those who work to expose waste and corruption.  That is why we are hiring some of the best 1st amendment attorneys in the business.

I was proud to tell our team of reporters, “ Don’t be afraid of the tough stories.  Don’t let this deter you from digging deep and shining the light where no one else will go.”  I boldly said, “Tell the stories no one else will tell!” 

We know we are making a difference. We have done our homework and we stand by our story’s conclusions.

The ball is in their court. 

We will not be silent and we will not shirk from our duty to defend the freedom of the press and the freedom of speech in this great country.

CEI Slapps Back In Closing Brief To Michael Mann Libel Lawsuit

Washington, D.C. – February 1, 2013 – Today marked the latest filing in a defamation lawsuit brought by climate science alarmist Michael Mann against CEI, National Review, and scholar Rand Simberg.  CEI has fought back against Mann’s lawsuit by moving to dismiss the case under the District of Columbia’s 2011 Strategic Litigation Against Public Participation, or “Anti-SLAPP,” Act, which protects the public’s right to engage in advocacy on issues of public interest.

Mann filed his lawsuit in October, 2012, in reaction to a July 13 CEI OpenMarket blog post by Simberg  comparing Penn State’s Climategate investigation of Mann to the school's initially shoddy investigation of the former, infamous football coach Jerry Sandusky.  CEI argues the blog post was Simberg’s constitutionally protected opinion, especially given its open reliance on publicly available sources.  This, coupled with Mann’s status as a highly outspoken public figure in the global warming controversy, places the blog post at the core of protected free speech.

CEI’s filing today responds to Mann’s opposition to CEI’S Anti-SLAPP motion.

CEI General Counsel Sam Kazman commented on today’s response to the Mann lawsuit.

 

As our reply demonstrates, while Mann paints himself as a reluctant warrior in the global warming debate, he’s quick to fling epithets at his critics.  Mann characterizes his opponents and their positions, variously, as “pure scientific fraud,”  “bogus,” “hired assassin,” “shills,” “crimes against humanity,” and the ever-useful smear of “denier.”  The professor claims that he’s been exonerated by numerous investigations, but those reports raise more questions than they answer.  And his view of First Amendment freedoms is so incorrect that, in addition to the Nobel Prize he wrongly thinks he won, he may now end up with a Pulitzer — but it won’t be for nonfiction.


The next step in the lawsuit may be a court hearing.

CEI and Rand Simberg are represented in the action by the firm of Baker Hostetler.

CEI SLAPPS Back At Climate Scientist Michael Mann’s Libel Lawsuit 

Invokes DC’s Anti-SLAPP Act to Protect Free Speech

 

Washington, D.C. – December 17, 2012 –  CEI and adjunct analyst Rand Simberg responded last Friday to Michael Mann’s libel lawsuit against them, National Review, and columnist Mark Steyn, with a special motion to dismiss the case based on DC’s "Anti-SLAPP" law.  The motion argues Mann’s lawsuit is precisely the type of lawsuit SLAPP (for Strategic Litigation Against Public Participation) is intended to curb.

The Anti-SLAPP Act, which took effect in 2011, protects the right to engage in advocacy on issues of public interest.   Mann filed his lawsuit in October, based on a July 13 CEI OpenMarket blog post that compared Penn State’s investigation of Mann in the wake of Climategate to the school's initially shoddy investigation of Jerry Sandusky.  CEI argues the blog post issue was essentially opinion backed by references to publicly available facts.  This, coupled with Mann’s status as a highly outspoken public figure in the global warming controversy, places this speech at the core of constitutionally protected speech.

“It’s ironic that an advocate of global warming is trying to freeze debate on this issue," said Sam Kazman, CEI General Counsel.  "Michael Mann likes to use the term ‘denier’, but in this case he himself is the free-speech denier.” 

CEI and Rand Simberg are represented in the action by the firm of Baker Hostetler.
