AUL marks a path to victory through election results

AUL says State Government Gains and Gubernatorial Leadership Mean More
Pro-life Gains Likely

In spite of the status quo results in the Presidential and Congressional election, the experts at Americans United for Life say that there is a path for pro-life victories through the results. AUL President and CEO Dr. Charmaine Yoest noted victories would be possible “because at the grassroots level, new pro-life leaders are taking their seats in gubernatorial offices and state houses across the country.”

Four pro-life governors won election last week. Among those is Indiana where pro-life hero Congressman Mike Pence is the new incoming Governor. In Congress, Mike Pence was a prominent pro-life leader working year after year in an effort to completely defund Planned Parenthood at the federal level. Pro-life incumbent governors won by big margins as well.

State Legislatures made the switch to life-affirming leadership. Due to changes in some state legislative chambers, new pro-life gains are now probable in states like Arkansas, which had an historic change of power. Also other states like Indiana and North Carolina picked up more pro-life seats so they are now at or near supermajority level.

The balance of power we see in most states means AUL and our allies can continue to make significant legislative gains for life, as we have in the last few years, said Dr. Yoest.

In a recent profile in The New York Times magazine, reporter Emily Bazelon noted what such state dynamics have meant to the work of AUL and Dr. Yoest. Legislative gains helped “push through the greatest number of abortion restrictions since the Supreme Court’s Roe v. Wade decision in 1973. In 2011, after Republicans made gains in statehouses across the country, 24 state legislatures passed 92 abortion restrictions — more than double the total for any previous year. The pace slowed in the first half of 2012, with 40 new provisions passed in 17 states. Around one-third of the bills, with names like the Abortion Patients’ Enhanced Safety Act and the Women’s Health Defense Act, were written by AUL.” To read the entire article, click here.

On the Ballot: A Round of Up
of Life-Related Initiatives

Citizens in several states voted on life-related ballot initiatives on November 6th.  Below is a summary of the results, and why they are important. 

A Win for Protecting the Ill and Elderly:
Massachusetts Q 2 Death with Dignity Initiative


Citizens of Massachusetts rejected the legalization of physician assisted-suicide, a decisive action that will protect vulnerable individuals facing the end of life.  The so-called “death with dignity” initiative failed to provide even basic safeguards and would have opened the door to a litany of abuses and dangers. Massachusetts’ citizens should be commended for standing by the principle that physician-assisted suicide does not affirm the life or the dignity of individuals facing serious illness or death. 

A Win for Protecting Vulnerable, Young Girls and their Children:
Montana Legislative Ref. No. 120: Montana Parental Notification Measure

 

A determined effort to protect Montana’s young girls prevailed Tuesday, when citizens voted to enact a law requiring parental notification prior to an abortion for minors 15 years of age and younger.  Prior attempts to protect pregnant, underage girls and their unborn children in Montana were thwarted by courts.  By voting for L.R. 120, Montanans acted to protect girls from sexual abuse and exploitation and from dangers inherent in abortion, while standing up for parental rights.  Research shows that when parents or guardians are involved in making an abortion decision, the abortion rate drops. 

A Win for Protecting the First Amendment Rights of Americans:
Alabama Amendment 6, Wyoming Constitutional Amendment A, Montana Legislative Referendum No. 122, and Missouri Senate Bill No. 464

   

Voters in three states — Alabama, Wyoming, and Montana — voted for state law amendments providing that their citizens should not be compelled to participate in any healthcare system (a similar measure failed in Florida).  By doing so, they voted to protect the freedom of conscience of individuals, employers, and healthcare providers who object to providing or paying for certain services that are included in a particular healthcare system, such as abortion or “contraception” with life-ending mechanisms of action. 

Voters in Missouri supported a measure prohibiting the establishment of a health insurance Exchange — required by Obamacare — by any means other than a legislative bill, an initiative petition, or a referendum.  Through this vote, citizens may successfully prevent Governor Jay Nixon, who is pro-abortion, from instituting new anti-life policies through the state’s Exchange.

 

Six States Challenge the Obama Administration’s HHS Mandate in Court 

 

AUL attorneys filed a brief this week in Nebraska v. Health and Human Services, a case initiated by the state of Nebraska and six other states challenging the Obama Administration’s “HHS Mandate,” which requires that employers provide insurance coverage for all forms of FDA-approved “contraception,” including life-ending drugs and devices classified as “emergency contraception.” To read more on AUL’s effort, click here.

As thousands join Americans United for Life Action’s “Team Life 2012,” the Washington Post took note.

Reporter Sarah Kliff observed: “Campaigns and outside groups have spent $16.7 million on abortion-related advertising during the 2012 cycle, two-thirds of that coming from abortion-rights supporters [but AULA is] launching a voter mobilization initiative meant to tip the scales in the other direction, and generate activism among anti-abortion voters … The effort – run by the country’s oldest antiabortion group – will ramp up over the coming weeks, with paid advertising, get-out-the vote drives and online networking tools.


“We did a virtual march for life a couple of years ago, where we signed up over 80,000 people in the space of 10 days,” AULA’s President and CEO Dr. Charmaine Yoest told the reporter. “It gave people a sense of community and a place to stand up and be counted on to take action. As we get closer and closer to the election, this is our main focus.”

As before, celebrity avatars are making their mark.

This week, AULA announced that Missouri Senator Roy Blunt and Governor Mike Huckabee, television commentator and former presidential candidate, joined the ranks of “Team Life 2012”. Those visiting the Team Life site will rally with a growing list of luminaries.

The Life issue can change the course of this election,” said Dr. Yoest.

According to a Gallup poll, 1 in 5 voters are guided by a candidate's abortion stance. Through on-line mobilization, we will inform voters about a candidate’s stance on life and help them make a difference in that race.

An AUL Victory for Women’s Health and Safety
in Virginia


In a decisive victory for women’s health and safety, on September 14 the Virginia Board of Health voted overwhelmingly to approve meaningful and medically appropriate abortion clinic regulations. By a vote of 13-2, the Board voted in favor of permanent regulations that, among other things, apply medical building code standards to all abortion facilities. This vote reversed an earlier action by the Board which had exempted existing abortion clinics from these physical plant standards.

Americans United for Life has led a nationwide effort advocating for meaningful and comprehensive regulations and oversight of abortion clinics, and provided testimony before the Virginia State Board of Health in support of regulations that protect the health and safety of women undergoing first trimester (and later-term) abortions in clinics across the state. Prior Virginia law only regulated facilities performing abortions after the first trimester, leaving the majority of women undergoing abortions unprotected.

Notably, over the last two years, at least 15 states have initiated investigations into and even criminal prosecutions against individual abortion providers and abortion clinics for substandard medical care and practices.  In some cases, these investigations followed women’s tragic and preventable deaths. CORNERSTONE’S 2013-2014 LEGISLATIVE AGENDA WILL PUT FAMILIES FIRST IN N.H. 

State’s Leading Family Organization Bases Bill Priorities on Goals Identified in Families First Pledge

 

MANCHESTER, N.H.—In an effort to successfully advance unfinished business and build on the successes of the past Legislative session, Cornerstone Action today is releasing its 2013-2014 Families First Legislative Agenda (PDF), which is based on the goals identified earlier this year by Cornerstone’s Families First Pledge for candidates.

“Today, as the filing period for incumbent candidates opens, we are identifying the types of bills we’d like to see lawmakers introduce as part of our 2013-2014 Families First Legislative Agenda, and these bill ideas are directly based on the goals identified in our Families First Pledge,” said Shannon McGinley, Cornerstone’s acting executive director. “We fully expect our pledge signers to introduce the bills identified in our agenda, and we intend to help those legislators advance these bills through the N.H. House and Senate and beyond the governor’s desk into the state’s law books.”

Cornerstone’s Families First Pledge secured the promise of more than 85 candidates for state offices to advance citizens’ rights of conscience and religion, protect innocent human life, defend the natural family and traditional marriage, restore the natural rights of parents to raise, educate and care for their own children, and enact free market economic policies to ensure prosperity in New Hampshire. Cornerstone’s 2013-2014 Families First Legislative Agenda uses each pledge goal as the basis for a list of bill ideas that conceptually align with each theme.

Today begins an eight-day bill filing period for incumbent legislators who were nominated by their party to run for a seat in the New Hampshire House and Senate. The filing period runs from Sept. 17 to Sept. 26, and then closes until after the general election on Nov. 6. Then, both incumbent and non-incumbent candidates will have another window between Nov. 13 and Dec. 7 to file additional bills. By the end of the second filing period, the bills that have not yet been filed from Cornerstone’s Legislative Agenda will be reserved for filing in the second year of the biennial legislative session.

“With the release of our Families First Pledge, Cornerstone articulated a high-level set of principles that candidates could align with prior to their election to office,” McGinley said. “Now that we’re getting closer to the time that these candidates take their seats in the Legislature, Cornerstone wants to make it clear what signing the pledge actually means in practice.”

The three bill ideas under the right of conscience goal would codify the N.H. Constitution’s Article 4 “right of conscience” so citizens could live their lives, conduct their business and spend their money only in a way that aligns with their own moral conscience.

“It is intrinsically evil to force someone to pay for something he or she morally objects to, such as an abortion,” McGinley said. “And no one should ever have to provide a service to someone involved in a practice that he or she finds offensive.”

Cornerstone is advancing eight bill ideas under its goal of protecting innocent human life, some of which have already had their first exposure in the Legislature and others that the organization is advancing for the first time in New Hampshire.

“Some of these ideas are simply common sense, such as the Women’s Right to Know Act, which requires abortion doctors to tell a woman about the child who’s life she’s about to end and the associated risks of the procedure she’s about to undergo,” McGinley said. “Other ideas in this category recognize in state law as much as legally possible that life begins when a baby is conceived.”

While at least one bill idea under the category concerning the natural family and traditional marriage would make another attempt at restoring the traditional definition of marriage in state law, the three other points focus on keeping families together and promoting natural family unity as the fundamental building block of society, McGinley said.

Likewise, the next category concerning parental rights recognizes that natural parents almost always know best how to raise, educate and care for their own children. 

"Parents should be given the benefit of the doubt unless they do something obvious to forfeit their natural rights," McGinley said.

Lastly, Cornerstone has identified six important free-market efforts that will ensure that families have the greatest opportunity to pursue their personal goals and achieve whatever they work for. 

"Inherent in these ideas is a balanced budget that reduces government spending on unnecessary bureaucracy and enables tax and fee reductions," McKinley said. "These bills will also ensure that government is lean, affordable and transparent to families all across New Hampshire."

 

Cornerstone Action’s 2013-2014 Families First Legislative Agenda

Preserve the right of conscience for all citizens, including their freedom to practice the tenets of their faith.

  • Pass the “Health Insurance Freedom of Conscience Act,” which creates a conscientious exemption to any mandate incorporated into a private health insurance policy for purchasers of a health insurance policy.
  • Create a religious exemption to contraceptive coverage as part of any private health insurance policy.
  • Protect the right of businesses to deny service to potential customers when it would violate the owner’s religious beliefs to serve them.

Protect innocent human life from conception to natural death.

  • Require abortion clinics and hospitals to report abortion statistics, adding New Hampshire to the list of 46 other states that currently require such reporting.
  • Pass the “Fetal Homicide Act,” which defines “fetal homicide” as criminal assaults on a pregnant woman that result in miscarriage, stillbirth or “damage to a pregnancy” as an enhanced offense for sentencing purposes.
  • Pass the Women’s Right to Know Act, which requires physicians to provide a woman considering the procedure with medically accurate information about her child and the abortion method that would be used as well as the long-term risks of having an abortion and alternatives to having an abortion.
  • Pass the “Rights of Motherhood Act,” which bans coerced abortions.
  • Pass the “Abortion Drug Safety Act,” and add N.H. to the list of 40 other states that require a prescription for drugs such as RU-486.
  • Pass “The Heartbeat Act,” which protects unborn children who have a detectable heartbeat.
  • Continue to prohibit taxpayer dollars from being used to fund abortions.
  • Ensure that surgical abortions are performed by a licensed physician (as they are in 43 other states) and that abortion clinics are regulated under the same standards as other ambulatory centers or health clinics.

Defend the natural family and traditional marriage, the foundational building blocks of society.

  • Pass a law that repeals gay “marriage” and either restores civil unions for homosexuals or restores the pre-civil union law in New Hampshire.
  • Improve parental oversight and control over public school classroom content.
  • Encourage policies that favor keeping families together when welfare dollars are at stake.
  • Eliminate no-fault divorce for parents of children.

Restore the natural right of parents to determine the best way to educate, raise and care for their children.

  • Pass a constitutional amendment that protects the natural rights of parents to control the health, education and welfare of their children.
  • Pass a constitutional amendment that removes “magistrates’” (judges’) involvement in educational funding and protects local control of education.
  • Create legal safeguards to ensure that both parents’ rights are protected in the case of divorce.
  • Require legal safeguards to ensure that parents’ due process rights are protected in cases involving their children and the Division of Children, Youth and Families.
  • Pass a bill that rejects the national Common Core Standards.

Enact free market economic policies that empower New Hampshire families to achieve their highest potential.

  • Pass a balanced state budget that cuts unnecessary spending and reduces taxes and fees.
  • Pass Right to Work legislation that makes it optional for all employees, public sector and private sector, to join a labor union and pay agency fees.
  • Repeal the Regional Greenhouse Gas Initiative to lower families’ energy costs.
  • Pass a bill that phases-in a 401(k)-style pension plan to ensure a government that families can afford.
  • Pass bills to prevent welfare fraud and abuse of EBT cards, reduce the number of welfare recipients and require recipients of taxpayer dollars to look for work.
  • Pass comprehensive health insurance deregulation to reduce the cost of private health insurance.
